We started with a new firm March 2016, he said the fees would be between 1,600 and 2,400 he put this in writing and said he wouold cap them at 2,400 for our peace of mind.
We have received a bill for 4,000 and our accountants senior partner is saying he had to more work than expected. We signed terms and conditions stating if there was any ad hoc work or the worked done couldn't be done within the agreed amount, then new fees would be discussed and this would be put in writing to us. None of this happened. We wrote a cheque for the higher amount of the cap but he has said he wants money for all the work he has done and will take us to court to get the rest. He refused to take the cheque, we told him we were more than happy to go court as we had a good case. We explained he just couldn't spend our money without our say so, we should have been given a choice to pay the extra 1,600 or stop him acting on behalf of us.

I agree with you. If you have documentation to support your view, fight it.
Ask for bank details to make a transfer. If possible, transfer £2400 as it will strengthen your defence.

If the fee quote is in writing and the Ts & Cs are clear then, as you say, let them sue.
Fight it. He is taking the pee.
Just be a little careful and read all the paperwork, if your accountant has given you a estimate for the work involved. That is not the same as a quote.

I assume you have engaged some large well known accountants ?
Certainly, would compromise somewhere and just move to a smaller firm that can give you transparency, great service and a fair price.

I had assumed as the big boys are notorious for overcharging and unpleasant surprises. Small is best.

No I wouldn't name them as that would be unfair and if they found out they may even become more stubborn

I think it would be best if we didn't continue with this conversation. For this reason, I have decided to close the thread. I hope you all understand our reasons for doing this.

Quite apart from the fact that your accountant fails to understand the difference between what they believe they are entitled to regardless of what they have contracted to receive, this whole affair sounds very unprofessional. Getting yourself a new accountant sounds like a matter of urgency.
