Our client (an individual in self assessment) has an old self assessment liability, in respect of which he has previously secured an agreement from the Business Payment Support Service to pay by instalments, which are collected by direct debit.

Our client has noticed that in the last couple of months no payments have been collected by direct debit.  Otherwise payments have all been made on time in accordance with the agreement.  It is not a question of any direct debits bouncing, they simply have not been requested.

Our client phoned HMRC to ask what is going on, to be advised that they are "reviewing" the agreement.  Our client there and then made payments by telephone to make up the amounts that should have been collected by them, and asked them to continue collecting the payments under the existing agreement with immediate effect.  HMRC have asked for some in depth and detailed information regarding his current financial circumstances and ability to pay, before they will agree to continue.  In the meantime they have now issued a demand for immediate payment of the full amount outstanding.

My question to you lot is this:  If you have an agreement already in place with the BPSS, and you have at no time been in default on your side of the bargain, to what extent are BPSS then empowered to vary the agreement?
