CIS AND OPTICAL FIBRE CABLES

   i have a client installing optical fibre networks. Overall his work is the same no matter who the client is

A number of clients deducted CIS tax from payments others do not

What should be correct treatment be ?

Guidance CIS340 says within CIS...

Page 66 says...that the following is WITHIN the CIS...

Installation of power lines, pipelines, gas mains, sewers, drainage, cable television and telecommunications distribution systems.

and the following NOT within the CIS...

Installation or replacement of telecommunication or computer wiring through pre-existing ducting in buildings.

Are they...

... overhead fibre optic cables? or do they have to dig up the ground to put them in?

The latter case would be a construction operation (so probably is the unlikely former!) and tax should be deducted by someone that is (or is deemed to be) a contractor.

My guess would be that the people that aren't deducting tax fall into two camps:

those that aren't (and aren't deemed to be) contractors,those that are doing it wrong (hopefully the smaller camp).
