Extended a year end not shortened

I have a client who is currently being investigated by HMRC, meaning their records are unobtainable. At first we shortened the Year end to have the extra 3 months and then extended their year end to try and have another 3 months to file and realised this has no left the accounts overdue with Companies House and they are issuing penalties. Can they accept an extension of a year end if it will mean the accounts being overdue?

Why are their records "unobtainable"?

HMRC must realise that the company needs its records to fulfil its legal obligation to submit accounts.

You can't change the year end when the accounts are overdue.

Hi Thanks, the accounts weren't overdue when we changed the year end. It was by doing so made them over due.

I'm guessing not if there's an investigation going on.

However, having the company struck off might be a sensible way of proceeding - depending on a dozen other factors we don't know about.
