Companies house late filling fee - £750

how can i appeal this fine and win

I am a new limited company and i struggled with the progress of filling accounts.

if i remember correct i had to apply to add service on HMRC and then wait for an activation code on Companies House.

I am in the Army and have been posted overseas, changing house while this date loomed. I was trying to do it for months but not really knpwing what i was doing, getting the service activated and waiting for activation codes and then services been removed and codes expiring it took me along time to get it all up and running and eventually file.

I have proof of posting assignments but i dont know if they will hold records of sending out various activation codes.

Helpful advice reqiured or even an accountant who can get me out of this mess.

It takes at least two whole years to go from forming the company to getting a £750 fine for late filing.

While you may have circumstances making it more difficult for you to file it was certainly not impossible for you to fix this long before now, I would suggest any appeal would be unlikely to succeed on the grounds that you missed every letter sent to you for two years, particularly when they can be sent to the address of your choosing.

You could just close the company? The fine will go away when the company is dissolved.

You can then start another firm - although maybe you shouldn't.

Here's your problem, pal.

You say you're in the Army. How would you like someone "not really knowing what they were doing" in your brick? For months.

Pay the £750 and ask for help earlier next time.

Its unlikely that penalty could be waived off. You have to submit accounts whatever your trading status is to avoid further penalty. Get help from professional as soon as you can.

If you had never succeeded in filing the accounts, you would never have been charged a penalty, which is for late filing of accounts, not non-filing of accounts.
