Continuation of old question pre online filing

Didn't find your answer?

Any comments.

Accounts submitted to HMRC.Filed OK with coys hse.

Sole director shown in Information sheet.Directors report shows directors name and date of approval.Balance sheet states approved by directors and date but due to printing error directors name not shown.

Also,FA 98 states only accounts to be prepared under the coys act required so presumably the detailed p&L a/c is not required as it is not a statutory requirement.

Also,FA 98 which is an information gathering power must be used with reason.

Thanks for your comments in advance.

You have lost me!

What is the question?

If it is "Are the accounts distributed to members and filed at Companies House in breach of the law if they fail to disclose the name of the director who has signed the accounts?", the answer is Yes - but who cares if CoHo has accepted them.

If it is "Is there a statutory requirement to submit a detailed P&L with the statutory accounts filed with the company tax return?", the answer is No - but it is a requirement to file computations to explain how the figures on the tax return are derived from the accounts and the normal practice to comply with this is to file a detailed P&L with the accounts, rather than with the computations.

Your "main question", which is still less than clear about the exact "above circumstances", did not appear in or could even be inferred from your original posting, but I have already covered it in the second paragraph of my first answer.  It seems that I have to ask your questions as well as providing the answers.

So, if the question is "Can HMRC reject accounts which do not contain a detailed P&L?", the answer is No - HMRC cannot reject just the accounts, but they can reject the entire tax return submission.
