I am preparing the tax return for a widow, whose husband died in May 2010. A collection was made at the end of her husband's funeral and the proceeds were split between two charities to which my client makes regular donations and has signed Gift Aid declarations. Can she claim tax relief for the one off donations made from the funeral collection, or are these regarded as donations of the people who attended the funeral? I presume that, as far as the charities are concerned, the donations will have come directly from the widow but what if the indivudals at the funeral also claimed their donations on their own tax returns. Has anyone else had experience of this?

She can only claim

for payments she made. Those received from third parties in the collection will not be allowable on the widows return

... she didn't make the donations out of her taxed income

That was what I thought but the charities will no doubt have reclaimed tax under gift aid based on her declaration. Thanks for your replies.
