Yes Oops...
you could just file the late returns but then of course they won't get processed automatically and HMRC will pursue regarding the penalties and interest (and duties if they havent been paid). You could get a penalty as low as 10 or 15% but normally they will seek 25% or thereabouts depending on all the ciercumstances

. The Company's corporation tax liability for both years? Have HMRC issued determinations on the company for both years? ABOUT 25K 04 05, and 5k 05-06, AFAICR NOT ISSUED DETERMINATION - I THINK PENALTIES BEEN PAID FOR LATE FILING [BUT NOTHING FILED?]

2. Confirmation if it is under enquiry (to also include company directors or associates of company directors)? NO NOT UNDER ENQUIRY - CONSIDERING VOLUNTARY DISCLOSURE

3. Has the company registered it has a liability with HMRC? NO THATS WHY I'M ASKING SO I CAN SORT IT OUT Have they issued a request for the company to submit a corporation tax return for the years involved? YES - STD CT letter THING SENT AND NOT RETURNED

4. The reason why nothing has been submitted to HMRC (The truth please no matter how embarassing)? PROCRASTINATION AND INEPTITUDE - money has never been 'hiddne' it's always been in the ltd co bank acct.

Has the company ever incurred such a penalty for this before? NO

5. The trade carried out by the business? OMB IT CONSULTANCY

6. Are you advocating Voluntary disclosure if 2 is negative? YES THATS WHY I'M ASKING [I'M NOT AN ACCT, LOL]

7. Are the company's other tax affairs up to date ..(PAYE/VAT/CIS) etc? YES, VAT AND PAYE ARE OK.

AS NO CT RETURNS FILED CAN I JUST SUBMIT LATE RETURNS SEE WHAT HAPPENS??

Can you confirm the following as a bare minimum, it is difficult to provide an estimate of likely penalty (including possibility of criminal rather than civil proceedings) without further details.

1. The Company's corporation tax liability for both years? Have HMRC issued determinations on the company for both years?

I suppose it is a bit like going to the doctors with a cough and asking if it is fatal, before the doctor has had the opportunity of examining you.
