Afternoon.

Was just about to submit a CWF1/64-8 for a new client who wishes to act as a self employed personal carer, looking after her partners sister who needs 24 hour attention. The sister now lives with her brother and partner in their home which they have deemed to be more suitable than her going into care.

Just dawned on me that I shld may be going down the route of Employer/Employee or would Self Employment be ok. All of the work is being undertook in my clients home and therefore she will be providing all of the necessarry tools for the old girl.

Any thoughts ?

Is this going to be paid privately via the sister-in-law's own funds or via direct payments from social services as a result of a care plan?

The brother will be paying it direct from the sister inlaws funds as he has power of attorney on all of her affairs.

If she is only working for one person on a full time basis I am not sure how succesful a claim to be self-employed would be.

There may be issues if the lady is subject to any kind of care plan which may need looking into before the whole business of paying comes up.  Depends on the health authority and so on, but your client will be working with a vulnerable adult.

As you describe her as an 'old girl' - I would get in touch with Age UK ot the Carers Association, bith of which will know all the loop holes/regulations/possibilities.
