Hi,

A client is looking to make a worker redundant who has been on SSP for the last three months. They would usually have an irregular working pattern.

I understand that Statutory Redundancy Pay should be calculated based on a 'normal contractual weekly wage' or an average of the previous 12 weeks.

Is the period of SSP payments ignored under these circumstances? What is a safe and legal basis for calculating entitlement in this case?

A very brave employer, make sure they dot their i(s) and cross their t(s).

No idea how many staff they have, what considerations made re the role being eliminated and how the individual was selected, but if they have not taken good legal advice then they ought; selecting staff who are absent re sickness for redundancy leaves itself open to misinterpretation, so care is needed.

Have not done a redundancy is such circumstances but have done a termination under a compromise agreement for a member of staff who was ill long term and on our solicitor's instruction we jumped through a number of hoops to ensure no later repercussions re unfair/ wrongful dismissal claims.

I would also advise caution. Get your client to take good legal advice
