TR4 of the 2008 SA tax return

TR4 of the 2008 SA tax return which asks about supplying your services through a 'service company'.

We have quite a few clients who do this, no staff, but they are certainly not IR35 type companies.

It seems crazy that I am sat here with tax returns that are done but for this.

But if you ignore it, does that mean HMRC can use their new powers to impose penalties for not getting it right, and throw you in the tower (oh sorry, just realised the tower bit hasn't been enacted yet).

How are other dealing with tihs, or are you ignoring it due to lack of clarification?

Still waiting for ICAEW guidance. Per ICAEW website:

'Still not yet resolved
On 2 May we published a note on our newswire concerning the service companies question on page TR4 of the 2008 SA tax return.
We are unhappy with the way that this question and accompanying guidance have been worded. This is proving more difficult to resolve than the similar question on this year’s Form P35 and on which we gave advice earlier in April, because the taxpayer is required to quantify the ‘Total amount of any income included anywhere on this Tax Return, derived from the provision of your services through a service company.’
We will be meeting with HMRC shortly and will publish further guidance.

I'm posting all the figures to the software, working out the liabilities, telling the client what the payments will be (including making any claims to reduce for this 31 July), but telling clients there is a technical issue which our institute is clarifying with HMRC. Hence no Tax Return yet.
