Whats in a name

Whats in a name

Didn't find your answer?

A client and one of his friends set up co about two and a half years ago. As is the craze used initials as co name say ABC Ltd .

I was not aware of Co andCo never traded and has been struck off.

Has shown me demands for £200 for non filing of CT600 in name of ABG Limited and among his paper work he has an uncompleted CT41G in the name of ABG Ltd.

He has advised Rev that Co is ABC Ltd, it has never traded and has been struck off but they are still demanding Ct600 and penalty.

Apart from telling him to sort it out himself any suggestions on how to proceed?

Doubly cannot demand penalties from a dead entity that never...

...existed.

Invite HMRC to sue the company they are naming at leisure!

Image is of a pin up style woman in a red dress with some of her skirt caught in the filing cabinet. She looks surprised.

Return all post to sender

After beating your head against the brick wall that is telling HMRC they can't demand penalties from a dead/ non-existent entity (we're all in agreement on that one!) I'd start returning post to sender, once you're sure you've told them the situation in very, very simple language!

Not disagreeing with anything but...

...beware generally of claiming invalidity for a slightly misspelt document - S114 Taxes Management Act 1970
