I have tried, my client has tried, and neither of us have managed to get through - whether we call morning or afternoon.

After the initial annoying recorded message, the phone does ring for 15 seconds or so, but then goes back to recorded message/music, suggesting staff are simply cutting off calls?

I just want to check whether it's just bad luck or a definite problem.

The reason we want to get through is to confirm nil liability for 2010/11 for an annual PAYE scheme - unfortunately the HMRC 'confirm nil' web page onkly allows confirmation for 2009/10, so it seems they have not yet got around to setting up 2010/11 even though we are now past 5th April.

The client cannot locate the payslip booklet (assuming she received one in the first place) and so we are running out of options - there does not seem to be an agent priority number for employer PAYE queries.

However, I don't think the penalties for not confirming a nil payment apply to 2010/11?

Eh?

As an agent, you can confirm that no P35 is due for 2010/11 here, provided you know the client's PAYE scheme number and postcode.  The web page is headed 2010/11, but when I did it a couple of weeks ago, the Government gateway acknowledgement did say 2009/10.  Just print off the input confirmation page, showing 2010/11, before you submit the e-mail.

If no P35 is due, there can be no penalty for the late filing of one, whether you have notified HMRC or not.  A penalty may well be imposed, but just complain (not appeal) saying that they have no legal right to impose it and it will disappear.

Or are you talking about notifying a nil PAYE payment?  You can confirm that here provided you know the AO reference.  If you are talking about the surcharges, rather than penalties, for late payment, 2% of nothing is nothing.

Thanks for the response, but my questions are simply:
 

Is everyone else having difficulty getting through on the Accounts Office telephone number (I suspect staff there are letting calls go onto hold unneccassarily)
 Failing getting through on the above number, is there a way of confirming a nil liability for a PAYE annual scheme online (the confirm nil PAYE web page does not have 2010/11 as an option yet, but does have 2009/10! and month ending 5/4/11 which is not applicable for an annual scheme).

I try not to call the AO Shipley because there never has been a rapid response.  We shall have to see what happens when they start issuing late payment surcharges for 2010/11 and everyone wants to check the payments record.I see what you mean about not being offered the option to notify a nil payment for the year 6 Apr 2010 - 5 Apr 2011, but I don't think it is necessary if you have either notified that no P35 is due for 2010/11 or filed a P35 showing no PAYE due.  If you still feel that you ought to notify a nil payment, the next best option is 6 Mar 2011 - 5 Apr 2011.
