Each time a cheque was returned or a standing order was not paid the client has been charged £35. The £280 is calculated as follows:

Two unpaid standing orders £70
One cheque returned once £35
Another cheque returned once £35
Two cheques returned twice £140

i accept that the client should not have written the cheques unless there was sufficient money to pay them but a £35 fee is excessive.

Has any member been successful in challenging business account charges as opposed to personal accounts?

Bark charges/Oft case
Please be aware that the OFT case between several banks is concerned only with personal and current accounts-Business bank accounte remain unaffected since a claim for repayment of charges falls under common law and NOT unfair consumer contract terms.
Also exempt from the litigation is credit card charges....these have already been invsetigated and were deemed as excessive by the Oft.
The Oft has also agreed waivers for banks to investigate complaints within the 8 week timescale laid down by the banking code.......the waiver will be in place for 1 year on conclusion of current litigation.The banks in being given the waiver agreed to look sympathetically at hardship cases (where claimants were experiencing financial difficulties)
I an on my second business claim with Barclays Business and although the court stayed the process in anticipation of the test case-I have applied to have the stay lifted and Barclayss say they are happy to agree because they accept this case should be allowed to proceed.
Whatever conclusions arise from the current litigation,its widely expected that an appeal will follow which potentially could see the case going on for up to another 2 years.
I am challenging charges outside the limitation act and have submitted supporting grounds for this and also include references to precadents previously set.

I've a farming client in the same position
What makes it even worse for my client is that the direct debits are to HP companies who then charge £41 penalty (which the bank pays) on top of the Bcy £35.

When I see that going out three times for a £115 HP direct debit and the DD is STILL unpaid I feel ill.

If the OFT wins its case against the banks I'll make sure my client is first in line!

I think it's the same principle as personal accounts. Bear in mind that some banks recently have been closing accounts, so if there's already a big overdraft, don't rock the boat unless you can open another account easily.

I also think that all payouts are on hold until a test case concludes in the courts, so the bank will sit on a claim until it knows it's position.

Bank Charges
I have successfully reclaimed bank charges on both personal and business bank accounts. Despite the test case still log your claim and the banks will act on it once the case is decided.
