If he won't provide my client with his NI number, in completing the P38A on behalf of my client, can I input name, address and amoun paid only. Will this form be rejected? - surely it will be. Alternatively is there a quick way I can find out an NI number in order to process the year-end returns by the 19th May? Any ideas welcome. Casual has not signed a P46 either. If I sent the return in manually instead of electronically, does it make any difference - I was hoping to do it electronically in order to get the £150!

I think you can file on line
I have filed on line where someone didn't have an ni number (they were foreign and hadn't received one yet). I left it blank and that went through ok. The problem you have is that on the p38/p35 is a declaration to say that all employees have signed a P46 or got a P45, which you can't do. If they won't sign the P46, they should be on a BR tax code. That might concentrate their minds a bit!

Filing online
If there are other employees who have had PAYE deductions (or have at least been paid over the NI LEL without any deductions), you can file the P35/P14s online and earn the £150 incentive. The P38A is not part of the online filing requirement and it can be submitted separately on paper without losing the incentive.

If you have other employees for whom a return is necessary, you might as well include your casual worker in the online filing even if no deductions have been made. You should leave the NI number blank and input his gender and date of birth. If you do not know his date of birth, enter 01.01.1901.

NI number trace
You can use the NI number trace service. Complete the form (downloadable from HMRC website), fax it and, in my experience, you should get a response within two weeks.
