He wants to pay the chauffeur out of his trading company but not under PAYE, just by the driver giving him an invoice.The car is the client's own personal car.

Q.1 If the only journeys are for business(eg between 8 and 5 each day) then will the BIK then not apply.?

Q.2 Should the chauffeur really be on the books as an employee as he will be available to drive for the client every day.

If this guy drives for your client every day, taking instructions from the client and driving a car supplied by the client, I can't see how HMRC will ever be convinced that he's self-employed.

Why?
Why does he want to shirk his duties? The person is a domestic employee. If it's the hassle of dealing with the paperwork and taxes, he can hire the domestic through an agency that arranges all that sort of stuff.

Incorporate the driver, and the tax issues are then his problem.
