Childcare again

My client operates a one-man company and owns 100% of the shares. His wife is a higher rate taxpayer and receives childcare vouchers from her other employer. She is the company secretary but not a director of my client's company. Can my client's company make direct payments to the nursery and obtain advantage of the £55pw BIK exemption both in relation to the husband and the wife. There is only one child, although I do not think this is relevant. I read somewhere that if an individual is receiving childcare benefit exemption from one employer then it is not also possible for this to apply to a second employer but I would be grateful for a statutory reference to this.

I'm not sure of a reference, but each tax payer can only claim once for the £55 per week (£243 per month) of childcare.  Therefore the wife can not claim again, but the husband can through his company.  The nursary would have to issue two invoices, one to the value of £243 per month directly to the company, the remaing balance to the husband and wife.
