Company struck off then cheque received

Company struck off then cheque received

Didn't find your answer?

I have been approached by an individual who has previously run a company which is now dissolved.

Recently he has received a cheque (about £900) from the Inland Revenue who apparently didn't know earlier that this was due back.

As such he now has a cheque which he cannot cash - do I have to have the company restored? and if so is it financially worth it?

thank you
Rachel

Sometimes
We've found that the (former) Inland Revenue are reasonably happy to reissue the cheque on a written request, but the former HMCE just say hard luck!

Property of the Crown?
Don't assets and funds of a dissolved company belong to the Crown?

An approach
Return the cheque to the Revenue with a letter, and ask them to replace it with one payable to the shareholder.

I've done this a couple of times when the Revenue drags its heels over tax repayments for defunct companies.

It's bona vacantia
Company restoration is quite costly with over £300 of court fees just to get started.

The government department responsible for property of dissolved companies is the Treasury Solicitor's bona vacantia section. They can be quite helpful in resolving such problems and have extensive guidance on the government website.
