Directors and P45's

Directors and P45's

Didn't find your answer?

A client operates through a personal service company (this is NOT an IR35 question!), but work has temporarily dried up.

He wants to sign on but has been asked for his P45. Should I prepare a P45, given that he is still "employed" by the company and fully intends returning to work and trading though the company wehen work picks up again.

Thanks

Colin

Depends
Technically No. Your client has not been dismissed, he has simply been laid off.

Unfortunately the Job Centre's computer struggles to handle lay offs. How times have changed!

Additionally the work of obtaining more work is not work in expectation of remuneration and therefore doesn't count for the purposes of Job Seeker Allowance claims. However expect to have to appeal to get hold of somebody who actually understands the rules and case law.
