Is an Employer legallly binded to pay out all Employee Tax Refunds due or can they defer a Tax Refund due to Cash flow, thus leaving the Employee to obtain his/her refund direct from the Tax Office? In answer to initial comment left - Clients are complaining about the fact that the Refund has to come out of their weekly Cash - whereas the Tax and Ni is handed over to the Revenue on a monthly or quarterly basis.

Have to pay it anyway
Surely any refunds are just netted off PAYE due to HMRC so instead of paying over all the deductions in a given month, part of it is being paid to an employee as a refund.
