I have two Section 9A enquiries (into business travel relief claims) that have been ongoing for almost 2 years. The enquiries are the same, the clients are brothers who worked for the same company, the tax district is the same, the only difference is that they are being dealt with by separate offices within the tax district. The one enquiry which had gone almost as far as being listed for a GC hearing was agreed. I provided a copy of the letter stating that the expenses had been accepted by the other tax office and that the circumstances & evidence provided was the same. However, they are saying that every case is dealt with on an individual basis and is refusing to budge on their conclusions disallowing all expenses (which are allowable). Can anyone give me a little bit of an idea how to deal with this because my brain has gone to mush!!

Problem more complicated
Thank you Trevor for taking the time to give me your thoughts regarding my dilemma. Unfortunately, as i explained in my question, the one enquiry was concluded a few months ago so I am unable to go to both enquiry officers and take both cases to GC. I would be very grateful for any other ideas!!

Mark your letter specifically for the intention of the Complaints Officer.
Ask for the case to be subject to "peer review".
