I have had a long standing case on employment status dragging on for months and I suspect it will go to the Commissioners - any pointers/tips gratefully received.

Just stick to the facts
Just be honest

- I think they are normally just "ordinary people", who happen to be qualified accountants or solicitors. Not HMRC inspectors!

Its been a few years, but I always found them generally reasonable, understanding and fair.

'Specials'
You are more likely to succeed if you appeal to the Special Commissioners. This is obviously more costly, and you mght like to consider using Accountax Solutions of Milton Keynes, who have had great success in this area. It all depends on how much tax is at stake.

The General Commissioners cannot be expected to know all the nuances of tax status law and employment law necessary in a status case, and will have to rely on their Clerk for any legal points. They tend to issue pragmatic determinations. You could be fortunate, or unlucky with the 'Generals'...
