Holiday Entitlement / Maternity Leave

Holiday Entitlement / Maternity Leave

Didn't find your answer?

In a given year if an employee takes 26 weeks ordinary maternity leave, how much holiday does she get for the other half of the year, do you give her 50% of the usual holiday entitlement?
Or does the law require she gets the whole years entitlement to take in half a year!
Does anybody know?
Thanks,
James
Ps Our employment contracts just say its 20 days a year with no mention of maternity leave etc.

I believe
that all employment rights are protected for the statutory period i.e. the first 26 weeks. This includes holiday pay which would be accrued and taken upon return. The more difficult area is if you allow a longer period and then it comes down to company policy but be careful to treat the pregnant worker no different to other employees granted absence e.g. sabaticals etc.

Just to more explicit
Steven is correct.

If the employee takes 26 weeks maternity leave in a year she is still entiled to a full year's holiday entitlement. The situation is just the same with sick leave, but maternity leave tends to make the situation more obvious.
