For an agency worker who works irregular number of hours each week, what can be taken as the normal number of hours included in a working day for the purpose of calculating the number of days he is entitled to annual leave? (holiday entitlement is calculated on the basis of hours i.e. multiply hours worked by the appropriate percentage 10.20% after 1/10/08). Then the employee wants to know how many days he is entitled to. To give an answer to that, what number of hours divide the total number of hours by? I hope it makes sense. Thanks.

Average it out
Normally I take the average of the last 12 weeks or you could set a contract minimum hours and then holiday pay is based upon the contract minimum. If however the employee is constantly working more than the contract minimum you have to amend the contract to reflect this. I have a duaghter working for a large retail chain, contracted 8 hours per week but for past six months worked an average of 30 hours, recent holiday pay made was based upon the 8 hours and was told correct, contractually!!!
