My client is an IFA who incorporated . He now has significant insurance commssion clawbacks which relate to his sole trade . Clearly he has no post cessation receipts to offset these against .We had transferred goodwill to new co and would have offset these against company receipts on the basis that if the benefits of existing contracts was transferred so should the obligations . However our client now advises that FSA requirements are that goodwill is not disclosed on the company balance sheet. Can anyone advise re this and how relief can be obtained for the clawbacks .A S109A claim on the personal return is a possibility but will still leave excess unrelieved clawbacks .
