 We have just informed IRIS that we are not renewing our software license after the quarter ended 31 March 2011.

The response to this was that we need to give 90 days notice if we no longer wish to continue with IRIS. 

After checking our printed copy of the License and Support Agreement (printed out in January 2009). the original notice period was actually 30 days. On querying this, we were informed that the new Agreement has been in use since September 2009 and that every time we updated IRIS we accepted the revised Agreement.

I am not sure how many people actually print off License Agreements every time they renew their software licenses and actually read them - maybe this is a failing on our part - but even so, I do not recall receiving anything from IRIS either by email or letter stating that the terms of the License Agreement had changed. I may however be wrong on this point and missed/ignored(?) this letter/email.

Can anyone out there confirm that IRIS did indeed send out a notice saying the License Agreement terms had changed and, if they didn't, is it legal to change the terms?

One other point, can someone confirm that there is a point when updating the software that you do confirm your agreement to the terms and conditions. I think with this point I am having what could be termed "a senior moment" because I cannot recollect doing this with an update (as opposed to the original installation of the software).

always send an updated licence with every  upgrade CD. Not sure how they deal with it if the upgrade is downloaded online..

A case of caveat emptor. Who reads most licences anyway?

Yes you have to accept the licence terms every time you put on an Iris update.  Same as pretty much every other software.

And like most people I just click the box to say I accept, as there isn't normally a button to print the agreement to read later, and I don't have the time or desire to sit and read through pages of licence terms on the screen.
