local authority pension schemes - loss of dependant's benefits

local authority pension schemes - loss of...

Didn't find your answer?

I have a client who is in receipt of a widower's pension from Oxfordshire county council in respect of his late wife's employment with them. She died in 1992 and he re-married in Nov 1998, prior to becoming a client.

He has just heard that a dependant's pension should perhaps have ceased on his remarriage, but that remarriages post April 1998 are exempt.

Does anyone know the generic position re local authority schemes, or specifically re Oxfordshire?

Need to seek advice
The Local Government pension Scheme website (http://www.lgps.org.uk) says:

"If your husband, wife or civil partner left the LGPS before 1 April 1998 and you remarry, cohabit or enter into a new civil partnership after 31 March 1998, your pension fund administrator can decide whether your pension continues or not."

So your client needs to seek advice from the administrators.

The administrator for Oxfordshire CC can be found on 01865 816565 or at:

Oxfordshire County Council
Pension Services, County Hall
