My client has come to me from a previous accountant amd the locum arrangement has been in place for perhaps 18 months. The locum has her own referrals and patients and there is a written agreement between the locum and my client clarifying issues of client ownership eg which is vested in the individuals.

This is almost a case of room rental in its simplest form or there could be an implied employment contract. I would assume in cases of negligence that the claim would be against my client firstly with a counter claim upon the locum.

I would be grateful for your comments on the employment status or otherwise of this arrangement. Many thanks

A Principal and an Associate realtionship?
I think the relationship would be as associate and a principal(like in dentisry) if the locum, has a practising licence from her professonal body(medical board approved)then the locum should bear the responsibility

Thanks Ganga, I am aware of the dentist associateship idea but am a bit concerned how this extends to other health professions.
