Nil expenses or benefits
We have some limited company clients for whom we are proposing to submit P11Ds. However we are unsure if we need to submit one.
Some of these companies do not have any company cars, overdrawn loan account or any other benefits or expenses reimbursed. Are
you required to send in the forms in such cases as well? Guidance notes says "You should not complete a nil P11D if there are no expenses payments or benefits to be returned for an individual." Does it apply to the directors as well?

You are not required to submit nil P11Ds.
HMRC even told me I don't need to tell them I don't need to submit a P11D even if I said I would submit P11Ds later on the P35.
Unless the P11db was issued to the company
If a form has been issued and is not returned penalties will automatically be issued until the form is filed.
P35 tick box no P11D forms due
You have probably (I hope) already submitted the relevant P35 returns.
The P35 declaration section had question reading something like (you tick one of the boxes):-
EITHER
# P11D and P11D(b) forms will follow
OR
# P11D and P11D(b) forms are not due
If you are certain that P11D and P11D(b) forms are NOT due then why not go back and amend the online-filed P35 forms ?
ie. make sure that the "P11D and P11D(b) forms are not due" box is ticked.
What about penalties?
If you amend the P35 after the penalty deadline won't you be subject to penalties?
P35 amendments - not seen any penalty imposed
When a P35 has been filed on time and has been complete at that time and subsequently there's been an amendment I've not seen any penalties imposed.
Doesn't mean there can't be penalties though !
