Friend of a friend just rang HMRC to chase his tax refund, following submission of ITR in September, only to be told "we dont have to deal with it until January 2007, so you cant have it until then"!
Anyone else experienced this? This was St Austell (Devon Area).

I think my area are the worst!
My area admit to having a 3 month back log of unopened post.
I put a client's refund for company CIS in on 27/7 and it still hasn't been paid. It is for a substantial sum and the client is now desperate. I was told they couldn't see why he was annoyed!
I won't name them but they are a south coast area with a premiership football team!
Good service from NWM & Shropshire
I submitted two CIS25 refund cases to North West Midlands & Shropshire last month (October 2006).
One was by FBI and one was a paper return.
Both refunds were dealt with promptly - I was particularly surprised to see the paper return dealt with in less than 3 weeks, not quite as fast as the FBI return, but unexpectedly quick all the same.
Should get it back
If there's no liability under Self Assessment (including Capital Gains Tax) for 2005/06, you should get the repayment in full now.
It's only if you are within a month of another payment being due (e.g. requesting a repayment in January with a payment on account becoming due at end of month) when they will not pay out.
If your client has an income tax overpayment to be refunded but is due to pay Capital Gains Tax (which is only due on 31st Jan 2007) I am afraid that you won't win an argument that the income tax should be repaid - can't remember the reference in TMA1970 I'm afraid.
No defense but:-
I've just discovered, in passing, that a paper return received by NW Mids & Shrop towards the end of September has not yet been processed.
Maybe your friend just came up against a cockroach who prefers being aggressive to being apologetic for their lousy service.
