Hello

Company is late filing first accounts - one month at the moment.  

The delay is due to employing unsuitable and having many changes staff.  Therefore the information is not accurate enough to send to CH.   A letter was sent to CH explaining the situation.  Company has now received a notice of prosecution letter if accounts are not filed by 24 December.

Although the accounts will be more accurate by then they will not be a true reflection.

What do you suggest regarding this situation?

PS The company is a small company and comes under FRSSE

That canot be right!

Companies house do not normally issue such notices if the accounts are only one month late, as you say!

Are sure they are not more than one month late? or is Company a serial offender?

Do not recommend this, except as a last last resort

You could file the best accounts you can, then file amended accounts later on, when you know they are right. No time limit for this. Again, should normally be avoided.

Traffic warden mentality

Companies House are more incompetent that even HMRC.

They work on the bais that "ruiles are rules" and have what I would call a "traffic warden mentality". 

We were in a similar situation and simply filed a set of accounts riddled with estimates, and endorsed them with the explnation that estimates had been used due to the intransigence of Companies House. We then went on to detail exactly why it had ben impossible to file fully audited accounts within the specified time limits.

Companies House spat feathers, but, our action was lawful and we informed them of the potential costs should they refuse to accept the accounts, including our intention if necessary to obtain a pergative order from the High Court and judicially review their refusal.

By the time they had wasted weeks finding out that we had them over a legal barrel the proper accounts were available and ammended accounts submitted.
