£900 penalty, reduced slightly as tax liability on P35 less than £900.

Penalty notice issued late with all the others.

Good sympathy fact pattern, but aware of (alleged) non discretionary nature of fine. Feel strongly on this case and doing it pro bono.

Intend to assert:
1 Revenue & Customs delays aggravated problem.
2 Penalty disproportionate to the crime (ICAEW argument)
3 Equitable liability argument
4 Taxpayer not treated as others who have had penalty waived (but I need evidence to use this argument - can anyone help me out on this one please).
