An employee (director actually) of one of the companies I do the payroll for has just become a father and had a week off. I think there are two options:
1: he takes the time as holiday (he has loads of holiday left this year), and I pay him as normal, or
2: he takes the time as paternity leave, I pay him £102.80 for the week, the company gets it all back, together with a bit more to cover the inconvenience of administering the SPP (Yes, total NIC's are less than the limit).

Are these two options mutually exclusive, or can he take the time as holiday AND I pay him the SPP on top of his full salary (again getting it back with the compensation)? Is the payment of SPP dependent on the time off being taken as unpaid paternity leave?

I'm no expert, but...
I believe the leave (one or two weeks and not just odd days) has to be taken to qualify and is in all other respects 'unpaid'.
