Previous accountant lost client's records.

New client (small business trading from home) claims that previous accountant lost his records and no tax return was filed for 2003/04 (ceased trading after that but has restarted recently). Client paid an amount on assessment by IR but needs to submit tax return to stop penalties. Client says has no admission in writing from previous accountant. This is a cash business and there are accounts for the previous year. Any advice please how to proceed with the year in question? Thanks.

Nice One.
They are fantastic these kind of clients aren't they. Grown up people making some kind of living but unable to ask the previous accountant the obvious questions. Accountants are like doctors, blamed for all sorts of things by people who do not have enough sense to adopt the simplest or crudest methodology for record keeping.

My apologies James, but I cannot believe these clients who have the capacity to act like five year olds! Why has he suddenly approached you regarding 2003/2004. He must have received Determination Notices which I assume is what you refer to as "an assessment".

Another minor issue, what kind of business does he operate?.
