Property and entrepreneurs relief
Hi
we have clients who incorporated their partnerhsip business on 31.03.2008 and claimed taper relief. A property owned by the partnership (was on the BS) and used in the business was retained in individuals' names. They are planning to sell the property now. The property was rented to the compnay at less than market value for one year but not now. Will entrepreneurs relief be available? if yes, should we apply rent related restriction? Your references to the legislation and HMRC manuals will be appreciated as we have a disagreement in the office and need supported opinions.
