We have had a spate of letters from HMRC relating to 2013 Returns that were filed on time, for which HMRC have PAYE information that does not match the Return.  The letter says they are checking the Return and will raise a discovery assessment for additional tax found to be payable.  However, as they are out of time for a Section 9 enquiry, there is no legal basis for the "check" letter.  Our "go away and do it properly" response is getting a non technical reply that regurgitates what is in te original letter...just in more words. 

Is anyone else having a similar experience?

Go away and do it properly involves them raising  a discovery assessment, you appealling and then explaining to them why it is wrong.

The legal basis for the "check" letter is surely FA 2008, Sch. 36, para. 1, para. 21(3) and para 21(6).

Aren't you beating yourself up unnecessarily?
