Hi All,

I have registered a client for VAT on 15/02/2012 but have registered him with an effective date of 01/01/2012.  Does this mean that he can produce an invoice for services rendered after 01/01/2012 and add VAT?

The reason I ask is that this person is a celeb and the management firm are holding the money for him until such time as I registered him for self assessment and VAT.  They charged VAT on their invoice to the production company and so if he charges them VAT on his invoice they will be able to claim this back.

He is also charged commission + VAT from the management company, so as long as their invoices are after 01/01/2012 can he claim back the VAT charged to him on their commission?

I believe the answer to these questions is yes but cannot find a sound answer on the HMRC website.  It only referes to re-claiming VAT on purhcases before registering but I read this as if his VAT registered date is 15/02/2012 he would start charging VAT after this date and not before but may be able to claim back VAT on purchases before this date.

What is the date shown on the certificate?

You are in danger of over thinking yourself here. The date is the date. VAT should be accounted for on all transactions after then, also you have already found the guidance about what you can do about purchases pre registration.

Pre registration
I think you can claim VAT back on pre- registration services incurred on business supplies up to 6 months before. So In any event so there should be no issue re recovrey here.

Remember you should include VAT on any sales invoices after 1 jan albeit not shown separately and with the proviso that you state registration in pending and that a vat invoice will be raised when registration confirmed.

The date on the certificate will be 01/01/2012 so yes, I now know that I have already answered my own question really!  Thanks a lot for your help guys.  It is just sometimes good for your own peace of mind to draw on other professional opinions to state, perhaps, obvious facts!
