Should all company directors complete personal tax returns?

It seemed that HMRC used to automatically pick it up, presumably from Companies House, and issue a notice to all company directors.

This doesn't seem to be happening, so should the agent inform hmrc that an individual is a company director even if there is no tax liability?

It has generally been HMRC policy to send tax returns to company directors, but there is only an obligation to file a return if (a) HMRC send a return to be completed or (b) there is tax to be collected for the year.

Personally, if there is no tax liability then I wouldn't worry that the director is not in the SA system.

I think HMRC generally pick up the directors details from the CT41G rather than Companies House. I have found where a CT41G has not been filed, the director is rarely in the SA system, unless they were already there in the first place.

This question keeps coming up!

The answer is No.  There is no requirement in s.7 TMA 1970, Notice of liability to income tax and capital gains tax, for a director per se to notify liability and hence, be issued with a tax return.

Why does HMRC site state Director's do need to?

You must complete a return if you're any of the following:

a company director (unless you're a director of a non-profit organisation, for example a charity, and don't receive any payments or benefits)
