Company registered in Gilbraltar but trading in the UK

Company registered in Gilbraltar but trading in...

Didn't find your answer?

CT isn’t my area (PT is often a struggle) but if an individual creates and company registered in Gibraltar but its trading activity is solely in the UK does it avoid UK Corporation tax?

The main director is currently in France (non-resident but dom here) but does spend time in the UK and will be returning in due course

Many thanks

If the company
Is effectively controlled in the uk then yes it will be chargeable to CT tax. Also if 50% of the shareholding is owned by someone who is tax resident in Uk then the company is liable to uk tax. Personally I think HMRC will want to know why the company was set up in Gibralter if its trading in Uk. It it's sole purpose is to avoid uk tax they will apply CT tax accordingly.
