I applied to Companies House for administrative restoration of a company however they have written to me stating that it must be restored by applying to the Courts. I have read up on the website - is it as complicated as it reads? Thank you

Set up new company with same name as old one

It can be easier to set up a new company with the same name as the old one.

Yes but if the reason for wanting the company restored is to obtain the return of assets that have vested in the Crown, setting up a new company serves no purpose. We haven't been told here what the reason is.

Yes John, the Company has to be restored to claim back CIS deductions suffered.

I have never done it, but why do you doubt the explanation on the website? Isn't it more likely than not to be accurate. In any case won't your client need a solicitor to handle the court application and can't he or she explain the process to your satisfaction?

Pretty straight forward
Write to the treasury solicitor requesting a waiver letter, paying a small fee (£60 I think)

Send off with appropriate forms (RT01 from memory) and any outstanding accounts, annual returns etc to Companies House.

Will be costs involved for late filing accounts if applicable.

Company should be restored to te register as though it was never struck off.

Thank you all for your responses. Ron, CH have said that administrative restoration is not possible as DS01 was filed to dissolve the company. I have read through the procedure but seems very complicated so I didn't know whether it was worth paying the extra £179 for someone else to do it.

Once a DS01 is filed, which is an informal insolvency procedure you are in the hands of the courts, you will need legal representation. Typical solicitor fees for a simple case would be around the £1,000 + vat mark with about £645 of Crown Disbursements. No other way I am afraid.
