I have a client for whom SA1 has been submitted (3 days ago) but we have not yet received a UTR and I think are unlikely to before 31 January.

I know that a late notification penalty is inevitable, but if we don't file the tax return by 31 January will they also get a late filing penalty? Or do we have 3 months from the date that HMRC then issue a notice to complete a return, which I assume they will do at the same time as issuing a UTR?

You have three months from being required

to submit a return, and that's paper or electronic as well

I think that it is just the late notification penalty, provided that the tax return is filed within 3 months of issue.

I would not say that a penalty is inevitable.  Unlike late filing penalties it requires human intervention to raise it.

And the penalty is tax-geared by reference to the amount of tax outstanding on 31 January 2015.  So even if a penalty were in the offing, the taxpayer has some control over the amount.

Making a payment without a UTR has some practical issues, but quote the NI No when paying.

Penalty

In years of working in tax I have yet to see a late notification penalty. I understand that providing the tax is paid by the due date of 31 January a late notification penalty will not be charged.

There will be no late filing penalty providing the Return is submitted within three months of the date of issue.
