We have a client who is a qualified social worker who has his own limited company he has spent about 38 weeks of the year in south Africa, he claims he is there applying for consultancy work and funding, he is doing a doctorate in social care over there which he claims is to establish work opportunities and to determine a strategic direction for doctoral research which would be likely to lead to further social development work. Can the company claim for subsistence and accommodation for the days he is there and if so do you consider a benefit in kind arises, I know there are similar tax cases but nothing I have found has given sufficient clarification on this so any help would be gratful.

He is UK domiciled and lives in the UK when not in South Africa, has a home in the UK (residency marginal)
