I have a client who last year ran her own PAYE scheme.  She had a director who took a hefty salary through the PAYE, however she did not tick the box that the director was a director and therefore has paid a lot more NI than was necessary....

There was  particular reason that salary was taken instead of dividends.

Is there anyway that we can make a claim to claim back some of that NI.

Consistent salary?

If they consistently took a high salary, then it is quite likely that the total amount of NIC would be the same on a cumulative basis as will have been taken monthly. Have you checked that there actually is an overpayment of NIC?

I am puzzled how it is that she has paid more than she would have if the calculations had been done as if she was a director. I see how the opposite might be the case. The point of the rules for directors is so that they don't use their ability to control their own pay to contrive to pay LESS NI.
