Do we have to honour her notice?

Do we have to honour her notice?

Didn't find your answer?

Hi all

We've got a employee who has been ill for few weeks. On Monday she got a sick note from her GP for another 2 weeks.

However this morning she emailed to notify us of her notice.

Question is do we still pay her SSP for the next 2 weeks.

Thanks in advance.

Notice

You are required to pay for whatever the notice period is.

Your employee has tendered their resigantion and you have accepted it.  So you now need to work out what pay they are entitled to for their notice period.  For example, if the notice period is one week then you pay one week's SSP.   After that they are still sick, but not an employee. If it's two weeks, then two weeks SSP and so on.

don't forget
you'll also have to pay any holidays accrued but not yet taken up until leave date at employees normal rate.

And don't forget that periods whilst sick qualify as periods accruing holiday pay- we once had an employee absent for 9 months , he had not worked during any of the holiday year yet was entitled to holiday pay for the seven months of absence within the final year when  his employment was terminated. i.e 7/12 of his annual entitlement.

Don't forget...

Don't forget to fill in an SSP1 form if the sick note is for a longer period than the notice.
