We have just taken on a new client, a very elderly former expat.
In his paperwork we found his P2 for the current year (12/13) which clearly shows a deduction for what looks like a full State Pension plus 'a bit'; we haven't got the detail yet.

The problem is that he never qualified for any State Basic and left the UK before SERPS started so it likes he is only entitled to a bit of grad pen which, he says he told them 'where to put it' so nothing. He does get a UK employer pension of about 11k but he has been geting over 5500 deducted in error so around a grand in excess tax annually.

We have already got the code ammended for 12/13 and 13/14 and are rushing off a letter to reclaim from 08/09. But what about before?
The client has never done an SA before and the data appears to have originated entitrely within/between HMRC/DWP.

I can't find any provision for an earlier recalim in the event of official error; any thoughts?

You could have a look at this concession.

You might also want to contact HMRC and ask them for how many years SP coded. It is possible it has not been coded in every year. It is odd as they would have to get an amount from DWP - did somewhere along the line someone perhaps "made up" an amount as they thought there should be something in a code for someone of that age?
