  I went to a discussion group organised by the CIOT regarding Follower Cases.

 I came away utterly bemused and depressed. Does anyone have any comments (clean ones!) regarding this dreadful piece of legislation?

HMRC like it!

Are there any examples of actual follower notices being issued rather than letters which threaten it?  Will it be any more successful than the GAAR which seems to be dying a death?

The cases I know are mostly to do with disguised employment involving overseas trusts etc where HMRC have threatened to issue notices but are yet to issue them. There are two issues which I can see with regard to follower notices:

1. It seeks to remove the cash flow advantage (holding on to it until the tribunal/court decides the case) 

2. A penalty of 50% if not complied with (s.209)
