From 6th April 2014, form EMI1 must be filed online within 92 days of the scheme being set up. We have been unable to register the client company for filing this online, as HMRC system doesn't appear to work. We are agents for every other service.

I have had the same issue with Form 42's and EMI40's. I posted mine, as it was not mandatory to file online yet. I suggest contacting HMRC to find out what the problem is. Online services may be able to help.

Bad system!!

This system does work however....

1) Client themselves needs to firstly register for PAYE online - it makes no difference if you, as agent are already authorised.

2) As an agent you need to request authorisation for Employment Related Securities online

3) Once PAYE online is up and running for the client, they need to register their own share scheme - until they do this, as an agent you will not be able to see anything under your agent login for the ERS system

4) Once share scheme is registered, your agent log in will work and you will be able to do what you want (i.e. file EMI1 forms etc)

 

Remember that step 1 takes around 10 working days as does step 2 although these can be done at the same time.

Step 3 then takes another 5 working days

I have spoken to numerous individuals and departments at HMRC but the most joy I got was by emailing '[email protected]' - from this I had a call back from the man in charge of the online service within 30 minutes and he talked through everything.

Even though IMO this seems to have been badly implemented, once the client has done their bit everything else seems to work so far - I have managed to register a new EMI scheme since April 2014 much more quickly and efficiently than by completing all EMI1 forms!

Bear in mind that next year all year end forms need doing online and therefore this process should ideally be strtaed as now to avoid delays next year!
