My client has moved to France in June this year.  She sold her home last tax year and is not intending to return to the UK other than trips to see her mother.

She has recently drawn down 50% of her pension pot and has therefore suffered emergency tax on the 25% which is not tax free.  As she has not worked since leaving the UK or received any taxable income, it is simple to predict her UK tax position ahead of 5th April.

Two questions:

  1. can I sign the form P55 on her behalf as authorised agent?  The form does provide for another person to sign the form but it doesn't state in what capacity.  This will save the task of posting her the form and then her posting it back to me (she has no facility to print documents).  HMRC's Agent Dedicated Line for SA told me that I could sign the form but it was less than convincing piece of advice.
  2. has anyone any updated experience of how long it is taking HMRC to process these repayment claims, which can only be done through the post?  I believe they originally quoted 28 days to process but I think it is taking several weeks in reality.
