I'm just wondering what others would do in this position? I did some subcontract work (very informally) about 6 months ago. The records were a mess and I wasn't able to contact the company directly. I listed all the queries out and raised a bill. Never heard anything more about it, no money received. Chased the bill, no response so I sent a legal action letter. Received a letter back offering 60% of bill as settlement as apparently the work was not up to scratch.

What would you do, would you accept the settlement or not?

On the limited info...

I would accept the 60% on the basis that the agreement was 'very informal'. 

 

Take the 60% and formalise any future sub-contracting work you conduct.

I realise that the info is limited, sorry I can't really elaborate further on the details. I'm tempted to dig my heels in for various reasons but the fact that no dispute was raised until legal action was threatened gets my goat!

I too would also accept on the basis of the information given as it appears there is no agreed quote and no engagement letter.

Has there been a counter offer from yourself of a higher percentage - would you accept 80%?

Depending on the amounts involved it may not be worth the costs to take it further as I wouldn't be confident you would get a judgement in your favour.

I agree with Ergath - ask for 80% and be prepared to settle at 70%.

Just a quick update

for any that's interested. I sent a polite letter saying that I disagreed with the decision to send a letter six months after the event and noting that no contact had been made to inform me of any problems etc, but I was not going to quibble over such a small amount of money and I'd rather just put it to bed. They agreed, promised to pay me (twice) but as of today - no money! Guess that teaches me not to do work "as a favour" to someone who said they were desperate.
