Hello,

I have question to those accountants who are interested with IR35 subject. Is there any specific law which says that haulage company cannot cooperate with one man limited companies eg drivers? I ask because this morning I had very interesting conversation with one driver who trades as Ltd and he told me that based on law he cannot work for any bigger company. Instead he has to use umbrella company/ agency to be able to work for Tesco, Lidl etc. I can see that more and more businesses prefer to coopeate with Ltd and I think this practise is carried on to move responsability to other party ( no contract, no employees, no need to pay holidays pay etc). On the second hand, small Ltd with no vehicles may be seen as employee rather than independent business. As a matter of exercice, I have done IR35 for this drive but result was 50:50.

I would be very grateful for any opinions in above subject.

Same rules apply not matter what type of business - if in doubt, get a specialist opinion (Accountax/Lawspeed etc)
